heather said… stu, a broken shoulder. gp says much worse than a broken collarbone and later will require months of expensive intensive physio. probably cant sue the negligent council. at one time could, so each state drew up statute law to protect authorities from compensation when roads poorly maintained. not covered by third party / mac although i have a registered and insured car. if govt changed / improved this, would be a way to encourage cycling. how do i lobby for this.
looked at sa law when prospect council was persuading dtei to 'upgrade' commuter / freight route churchill road while ignoring austroads re clearance between cyclists and trucks. in sa an authority can still be found liable when it does not follow current professional practice when modifying a road. so if / when you hear of a cyclist hit on churchill road, i can provide evidence of informing authorities while still in planning stage.
will be some time before i can type properly and continue advocacy. pain increases at the pc from sling around arm, but will not totally give up web while i am housebound.
heather said… hi stu. did not realise that you were an ac member cos you spoke of being busy. perhaps it is a rare thing that prompts you to post. shocked by the acc worker/s action/s and the serious cyclist injuries.
cycled in country nsw but did not get to sydney after cycling injuries due to poorly maintained road.
